CANNABIS INFORMATION

1. For all eligible Retail Cannabis Regulatory Permit Applicants, as of May 14, 2019, the appeal process has been completed and the Lottery will take place, May 23, 2019, at 5:30 p.m. in the Council Chambers at, 99 E. Ramsey Street, Banning, CA 92220. The lottery is open to the public and all applicants, interested parties, and members of the public are encouraged to attend.

 2. The City Council has eliminated the 600-foot separation requirement for Industrial Cannabis Facilities (e.g., cultivation, manufacturing, and testing). Prior to May 21, 2019, all industrial cannabis facilities required a 600-foot separation from residential zones. This residential setback has been eliminated; however, all other state-mandated setbacks still apply. The City of Banning Community Development Department is now accepting applications for Industrial Cannabis facilities, which are authorized in the Industrial zone. Cannabis California

Effective January 1, 2019, the City has begun the process of allowing certain commercial cannabis businesses (cultivators, manufacturers, and testing laboratories) and cannabis retailers to operate in the City.  The City Council has adopted a two-step process for commercial cannabis businesses  and cannabis retailers to lawfully operate in the City.  A commercial cannabis business or retailer must first apply for a cannabis regulatory permit in compliance with the provisions of Banning Municipal Code Chapter 5.35 and Chapter 5.33,respectively.  If the commercial cannabis business or cannabis retailer secures a cannabis regulatory permit, then it must apply for and obtain a cannabis conditional use permit in compliance with Banning Municipal Code Chapter 17.53 or Chapter 17.54, respectively. 

Only three (3) cannabis retailers will be issued cannabis regulatory permits and have an opportunity to apply for and obtain cannabis conditional use permits. The three (3) retailers will be selected through a lottery process.  Cannabis cultivation, manufacturing, and testing laboratory facilities will not need to go through the lottery process to obtain a cannabis regulatory permit or a cannabis conditional use permit.  

The schedule for the public workshop, application release and submittal deadlines, and public lottery are included below.
