[ARCHIVED] Banning Adopts Urgency Marijuana Ordinance

Banning, CA – The Banning City Council voted unanimously during its city council meeting on December 12th to enact an urgency ordinance that prohibits all commercial marijuana land uses including sales and commercial cultivation within city limits.

The recommendation for the ordinance was made after several meetings of the Marijuana Ad Hoc Committee comprised of Mayor Art Welch, Council Member Don Peterson, Police Chief Alex Diaz, Police Captain Phil Holder, Attorney Joshua Naggaer, and Community member Terry Wilson. The committee was formed in response to Proposition 64, the measure on the November 2016 ballot that legalized the recreational use of marijuana and created a new licensing and tax structure for marijuana businesses.

“Several factors had to be assessed including the fact that marijuana remains a Schedule 1 federal drug, as well as understanding the true impacts of marijuana enterprises on cities,” said Council Member Peterson. “For cities in Colorado, there were some interesting links between the legalization and sale of marijuana, and increases in both crime and social services.”

The urgency ordinance brings the city into compliance with Proposition 64 and identifies a permit process for those wanting to grow up to six plants on their premises. The permit requires that the applicant meet specific criteria and not engage in any sales or commercial enterprises.

The urgency ordinance goes into effect immediately and will be replaced by a permanent, non-emergency ordinance to be reviewed by the planning commission and the city council over the next few months.
